Well, (A) in a war, Cap's a soldier. He's always been known to have killed under those conditions. And technically he was still a soldier acting under legitimate orders of his lawful superiors throughout Winter Soldier, and if the Avengers have been given governmental support and license, as long as he's an Avenger he can operate as though a soldier.

(B) Everyone hit by Cap or by the shield is not necessarily dead. Yes, they fly or bounce around, but Comic Book Universe. The only way people like that are actually DEAD is if you SEE a lethal event -- head comes off, body falls on impaling object, someone grabs the body and does the Break Neck Twist, etc. Otherwise, not dead.

(C) Hey, some of those people on the Helicarriers could've jumped off and survived. How many? Comic Book Universe. All of those except whatever number they want to have died.

IIRC, Winter Soldier did take take some trouble to show Steve, Sam etc., putting out a general announcement to all lower-level SHIELD employees that most of the upper levels had been infiltrated by HYDRA, noting that anyone still launching the helical rivers could therefore be assumed to be knowingly siding with HYDRA, and asking each each other "How do we know who the bad guys are?" "If they're shooting at us, they're the bad guys." Which isn't perfect by any means, but under the circumstances was probably the best they could do to lessen the chances that they were harming people who weren't their enemies.

No, it wasn't perfect. But, as you say...
